Market Terms & Conditions

These Terms & Conditions ("Terms") govern your participation in the MetalMark Market program ("Program"), a white-glove service provided by MetalMark ("we," "us," or "our") for the consignment and sale of 24-karat gold bank notes ("Aurums"). By sending Aurums to us for sale through this Program, you ("Seller," "you," or "your") agree to be bound by these Terms.

1. Program Services

We will receive your physical Aurums, keep them in secure escrow, and, if needed, photograph and video them. We will then list and sell them on your behalf through our marketplace to our customers, subsequently shipping the sold Aurums to the buyer.

2. Seller Responsibilities

  • Shipping to MetalMark: You are solely responsible for all costs, including shipping fees and any necessary shipping insurance, incurred when sending Aurums to us for sale. We are not liable for any damages or lost items during transit to us.
  • Authenticity and Condition: You represent and warrant that all Aurums you submit are authentic and accurately described.
  • Withdrawal of Listings: You may withdraw your listings at any time.

3. Pricing

  • For specialty or rare Aurums, we will consult with you and take your price guidance for appropriate listing.
  • For most Aurums, we will determine the selling price based on current market rates, directly referencing the spot price of gold or specific price guidance for the type of Aurum being sold.

4. Fees and Payment

  • Commission: Upon the successful sale of an Aurum, we will charge a commission of 15% of the final sales price.
  • Shipping Pass-Through: Any freight shipping costs we incur when sending sold Aurums to buyers will be passed through directly to you. This specifically covers freight charges and does not include packaging or other supply costs, which we cover.
  • No Other Fees: There are no additional listing fees, photography fees, storage fees, or fees for failed sales. We also cover all taxes and packaging costs related to the sale.
  • Payment Remittance: We will remit the net proceeds of a sale (sales price minus our commission and passed-through shipping costs) to you within 10 calendar days of the sale.
  • Payment Method: For most transactions, payments will be remitted via PayPal in USD. For larger lots, other payment methods may be mutually agreed upon.

5. Risk, Insurance, and Quality Control

  • Insurance to MetalMark: You are responsible for insuring packages containing Aurums sent to us.
  • Insurance While in Our Care and to Buyer: We are responsible for insuring Aurums while they are in our secure escrow and during transit to the buyer. We maintain a minimum of $1,000,000 in general liability and product insurance at all times. We will cover up to $5,000 in insurance coverage for any single transaction.
  • Quality Control: If an Aurum submitted by you is rejected by our quality control process for resale in our market (e.g., deemed non-authentic or not as described), we will ship it back to you at our expense.

6. Return of Unsold Aurums

  • If you withdraw your listing, or an Aurum remains unsold, we will ship the product back to you at your request and our expense, unless we determine a pattern of abuse of this return policy, in which case we will charge for shipping.

7. General Provisions

  • Changes to Terms: These Terms may be changed at any time with proper notice to you.
  • AML & KYC Compliance: We adhere to Anti-Money Laundering laws and Know Your Customer policies.
  • Proper Tax Filings: For larger transactions, we will require and submit all proper tax documentation for proceeds.
